Privacy Notice

        Article 10 of the Law No. 6698 on the Protection of Personal Data (KVKK), titled “Data Controller’s Obligation to Inform,” regulates the address and information of the data controller, the purposes for which personal data will be processed, to whom and for what purpose the processed personal data may be transferred, the method and legal basis for collecting personal data, and the rights that the personal data owner may exercise against the data controller. It also imposes an obligation to inform about the rights set forth in Article 11 of the Law.

        In this context, Okan OPİNA Tekno R&D Inc. has prepared this Personal Data Protection Law Information Text to inform and enlighten data owners in accordance with the KVKK and related legislation.

        1. Purpose

        Okan OPİNA Tekno R&D Inc. (“Data Controller”) aims to process your personal data in accordance with the Law No. 6698 on the Protection of Personal Data (“Law”). This information text has been prepared in accordance with Article 10 of the Law on the Protection of Personal Data and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform, published in the Official Gazette dated March 10, 2018, and numbered 30356, to inform the data subjects about the processing of personal data collected by the legal entity and relevant units of Okan OPİNA Tekno R&D Inc.

        In this context, the Personal Data Protection and Processing Information Text has been prepared to inform and enlighten data owners in accordance with the KVKK (Personal Data Protection Law) and relevant legislation.

        Okan OPİNA Tekno R&D Inc. collects personal data such as name, email address, telephone number, company name, company email number, and company website (“Personal Data”) necessary for the User’s access to the Okan OPİNA Tekno R&D Inc. website and for the services requested.

        Personal data may be collected by the Data Controller through any auditory, written, visual, or electronic method.

        Okan OPİNA Tekno R&D Inc., acting as the “Data Controller,”

  • hereby informs you that your personal data will be processed within the scope of the purpose requiring their processing, in a limited and proportionate manner, and in connection with that purpose,
  • while maintaining the accuracy and up-to-date nature of the personal data as you have provided or as it has been provided to Okan OPİNA Tekno R&D Inc.,
  • will be recorded, stored, maintained, reorganized, shared with institutions legally authorized to request this personal data, and transferred, assigned, classified, and processed to third parties domestically or internationally in accordance with the KVKK (Personal Data Protection Law) and related regulations, and in the ways specified in Okan OPİNA Tekno R&D Inc.’s Personal Data Protection and Processing Policy and Special Categories of Personal Data Protection and Processing Policy.

        2. Collection and Procedure of Personal Data

        Okan OPİNA Tekno R&D Inc. will process your personal data in accordance with the conditions and purposes stated in Articles 5 and 6 of Law No. 6698, as well as in our relevant policy documents, as specified in this Disclosure Statement. Your personal data is collected through all kinds of information and documents submitted to Okan OPİNA Tekno R&D Inc. and through physical and electronic means belonging to Okan OPİNA Tekno R&D Inc. By registering online on the Okan OPİNA Tekno R&D Inc. website, participating in events and organizations, and using Google Analytics, the User directly provides most of the data collected through User preferences/connection features/browser preferences to Okan OPİNA Tekno R&D Inc.

        Okan OPİNA Tekno R&D Inc. collects user data in order to send emails and newsletters containing information about our cluster’s activities.

        3. Purposes and Legal Grounds for Processing Personal Data

        Your personal data may be processed by Okan OPİNA Tekno R&D Inc. for the purposes stated below, but not limited to these.

        Your personal data is processed to the extent required and permitted by the Law on the Protection of Personal Data;

  • When explicitly provided for in the laws,
  • When it is necessary for the protection of the life or physical integrity of the person who is unable to express their consent due to factual impossibility or whose consent is not legally valid, or for the protection of the life or physical integrity of another person,
  • When it is necessary to process the personal data of the parties to a contract, provided that it is directly related to the establishment or performance of the contract,
  • When it is necessary for the data controller to fulfill its legal obligations,
  • When the data has been made public by the data subject themselves,
  • When data processing is necessary for the establishment, exercise or protection of a right,
  • When data processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

        Okan OPİNA Tekno R&D Inc. always strives to keep the registered Personal Data up-to-date. This information sometimes comes from the User, and sometimes from publicly available registers. Where the provision of the service depends on the retention of the User’s Personal Data, this will be stated in the section regarding the use of the website related to receiving the service.

        Personal Data submitted to Okan OPİNA Tekno R&D Inc. is processed according to the purpose of data collection and the legitimacy of that purpose, and is stored in the cloud and subsequently in a permanent location, and is subject to continuous backup and deletion processes. The User can always withdraw their Personal Data by unsubscribing from the newsletter or by sending an email to Okan OPİNA Tekno R&D Inc.

        Okan OPİNA Tekno R&D Inc. will not use the User’s Personal Data for purposes other than its original purpose without the User’s explicit consent. Processing Personal Data for statistical purposes is consistent with the primary purpose.

        Okan OPİNA Tekno R&D Inc. website may contain links to other websites. This Personal Data Protection Policy applies only to the Okan OPINA OPİNA R&D Inc. website; if you click on links to other websites, you should read the policies of those sites.

        4. Transfer of Personal Data to Third Parties

        4.1. Transfer of Your Personal Data to Third Parties Within Turkey;

        Your personal data may be shared and transferred to Okan OPİNA Tekno R&D Inc.’s direct and indirect affiliates, business partners, suppliers, and other service providers, as well as legally authorized public institutions and private individuals, in order to achieve the purposes stated in the Personal Data Protection and Processing Policy and the Special Categories of Personal Data Protection and Processing Policy, within the framework of the personal data processing conditions and purposes specified in Article 8 of the Personal Data Protection Law.

        Okan OPİNA Tekno R&D Inc. will transmit the Personal Data it uses for website analysis and sending emails to the companies performing these operations, limited to this purpose only.

        Okan OPİNA Tekno R&D Inc. may use various service providers for IT activities or support. If these suppliers have access to Personal Data collected or processed by Okan OPİNA Tekno R&D Inc., the supplier becomes a sub-data processor working under a written contract with Okan OPİNA Tekno R&D Inc. and following its instructions. Okan OPİNA Tekno R&D Inc. is responsible for ensuring that these suppliers comply with legal obligations regarding personal data.

        4.2. Transfer of Your Personal Data to Third Parties Abroad

        In accordance with Article 9 of the KVKK (Law on Protection of Personal Data), the transfer of personal data abroad may be carried out in the following cases:

        In some cases, Personal Data may be sent to countries outside of Turkey or the European Union. These transfers will take place under the following conditions:

  • With the explicit consent of the data subject,
  • If the country in question is considered by the Turkish or European Union authorities to have adequate protection of personal data,
  • If the country in question is not considered by the Turkish or European Union authorities to have adequate protection of personal data, but Okan OPİNA Tekno R&D Inc. uses valid and customary undertakings/model contracts approved by the European Union or other competent countries regarding transfers to third countries and the United States,
  • If the company to which the Personal Data will be transferred approves the Confidentiality Protection,

        If the institution transfers data to third parties located abroad and acting as data controllers, the Personal Data Protection Authority determines the minimum requirements in accordance with Article 9 of the KVKK (Law on the Protection of Personal Data). In cases where both parties are data controllers, a commitment signed by both parties is submitted to the Personal Data Protection Authority. The data transfer will be made with the approval of the Personal Data Protection Authority, and the Authority will not transfer data to the said third parties without this approval.

        Okan OPİNA Tekno R&D Inc. is committed to protecting Personal Data. Okan OPİNA Tekno R&D Inc. has advanced internal security policies and has given all its employees the necessary instructions regarding the protection of Personal Data. Okan OPİNA Tekno R&D Inc. has taken the necessary procedures and implemented security measures to prevent the destruction, loss, alteration, damage, or unlawful disclosure to the public or unauthorized persons of Personal Data, or its processing in violation of laws regarding the protection of Personal Data.

        5. Rights of the Data Subject

        In accordance with Article 11 of the KVKK (Law on Protection of Personal Data), you can apply to Okan OPİNA Tekno R&D Inc. and request the following regarding your personal data:

  • To learn whether your personal data is being processed, the purpose of the processing, and whether it is being used in accordance with its purpose,
  • To request the correction, deletion, and notification to third parties to whom your personal data has been transferred, in case of incomplete or inaccurate processing of your personal data,
  • To learn the identity of third parties to whom your personal data has been transferred domestically or abroad,
  • To object to the processing of your personal data and to restrict such processing,
  • To object to the processing of your personal data for direct marketing purposes,
  • If the processing is subject to the explicit consent of the User, the User always has the right to withdraw their consent. The withdrawal of the User’s consent does not prevent the processing prior to this withdrawal from being valid and legitimate. The User can only withdraw their consent for specific services.
  • You have the right to claim damages in case of incorrect processing of your personal data,
  • To request the deletion of your personal data if the underlying reason for its processing ceases to exist,
  • To request to receive your personal data regularly, in a generally usable and machine-readable format (data portability),
  • To apply to the competent authorities regarding the protection of personal data,
  • To request damages in case of breach of your personal data.

If you submit requests regarding the issues mentioned in this text, Okan OPİNA Tekno R&D Inc. will process your applications free of charge within thirty days at the latest; however, if the process requires additional costs, a fee may be charged to you according to the tariff determined by the personal data protection authorities.
